1. Agreement to Terms

By accessing or using the KoalaFi App website (koalafiapp.com) and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and KoalaFi App ("KoalaFi," "we," "us," or "our").

2. Eligibility

To use KoalaFi services, you must:

  • Be at least 18 years of age
  • Be a legal U.S. resident
  • Have a valid government-issued ID
  • Have an active bank account
  • Have a regular source of income
  • Provide accurate and complete information

3. Lease-to-Own Services

Nature of Service

KoalaFi provides lease-to-own financing, which is NOT a loan. You are leasing merchandise from KoalaFi with the option to purchase. You do not own the merchandise until all payments are completed or you exercise an early purchase option.

Approval and Spending Limits

Approval and spending limits are determined at our sole discretion based on various factors. We reserve the right to approve, deny, or modify any application without providing a reason.

90-Day Same-as-Cash Option

If you pay the full cash price of your merchandise within 90 days of the lease start date, no additional fees apply. After 90 days, standard lease terms and payments apply.

4. Payment Terms

  • Payments are due according to your selected schedule (weekly, bi-weekly, or monthly)
  • Payments will be automatically withdrawn from your bank account
  • You are responsible for maintaining sufficient funds in your account
  • Late or missed payments may result in fees and reporting to credit bureaus
  • Early payoff is allowed without penalty

5. Credit Reporting

KoalaFi reports payment history to TransUnion and potentially other credit bureaus. This means:

  • On-time payments may help build your credit
  • Late or missed payments will be reported and may negatively impact your credit
  • You authorize us to report your payment activity

6. User Responsibilities

You agree to:

  • Provide accurate, current, and complete information
  • Maintain the confidentiality of your account
  • Notify us immediately of any unauthorized use
  • Not use our services for any unlawful purpose
  • Not attempt to circumvent any security measures
  • Care for leased merchandise until ownership transfers

7. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of KoalaFi or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOALAFI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

10. Indemnification

You agree to indemnify and hold harmless KoalaFi, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in class action lawsuits.

12. Governing Law

These Terms shall be governed by the laws of the State of Texas without regard to conflict of law principles.

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your access to our services at any time, with or without cause, with or without notice. Upon termination, your obligations under any active lease agreement remain in effect.
